Terms & Conditions
The following Business Terms and Conditions apply to flight bookings and any other travel services arranged by Safari Air Wing (Pty) Ltd.. Do not make a
booking unless you fully understand and agree to the following Business Terms and Conditions. We will rely on the authority of the person making a
booking to act on behalf of any other passenger on the booking and that person will bind all such passengers to these Business Terms and Conditions. A
contract on the Terms and Conditions as detailed in these Business Terms and Conditions will exist as soon as we issue a Booking Confirmation Notice.
References to “us” , “we” or “our” shall mean Safari Air Wing (Pty) Ltd
WE ACT AS AGENT ONLY
Safari Air Wing (Pty) Ltd is acting solely as an Agent for travel Service Providers nominated by us and not as a charter aircraft company nor an aircraft
operator, to which these Business Terms and Conditions apply, unless specified otherwise. Our business is to arrange and book flights at your request. The
delivery of travel arrangements are through third party Service Providers who are responsible for providing your travel services. We act as an agent for
travel related Service Providers and our obligation to you is to (and you expressly authorise us to) make travel arrangements as your agent on your behalf.
We exercise care in the selection of reputable Service Providers, but we are not ourselves, a provider of travel services and have no control over, or liability
for, the services provided by third party Service Providers. Bookings are made on your behalf subject to these terms and conditions, including conditions of
carriage and limitations of liability, imposed by these Service Providers. Your legal rights in connection with the provision of travel services are against the
specific Service Provider and, except to the extent a problem is caused by fault on our part, are not against us. Specifically, if for any reason (excluding fault
on our part) any travel Service Provider is unable to provide the services for which you have contracted, your rights are against that Service Provider and
not against us.
When you make a booking with us, you acknowledge and agree that we will be acting as an agent only for the relevant travel Services Provider, including in
relation to any travel arrangements that we may arrange and that neither Safari Air Wing (Pty) Ltd, nor any of its Directors, Employees or Agents has any
liability of any nature in connection with the relevant travel services, except as set out in these Booking Terms and Conditions.
Any services that we provide to you are collateral to our Agency relationship with the travel Services Provider and are separate to the actual provision of the
travel services. Any additional travel arrangements that you book or travel arrangements arranged by us, your contract will be with that Service Provider
and not with us and your legal rights in connection with such travel arrangements will be with that Service Provider. We will not be responsible for the
provision of any additional travel arrangements or for anything that happens during the course of the provision of such services by that Service Provider.
PRICES AND PAYMENT
Prices can be withdrawn or varied without notice. Prices are per person and inclusive of tax unless otherwise specified. We will confirm the correct price
with you at the time of payment. Prices are not guaranteed until full payment is received. To confirm your travel arrangements, a deposit per person will be
required. All deposits are non-refundable and non-transferable for changes of mind or cancellations by you. We will advise you of the amount of the
deposit and date for final payment when your booking is made. Certain travel services are booked at competitive rates to which Service Providers may
attach certain restrictions. You may be required to pay for these in full at the time of booking and the travel services may be non-refundable in the event of
a cancellation. Changes in transportation costs, including the cost of fuel, taxes or fees chargeable for services such as landing fees or embarkation or
disembarkation fees at airports and exchange rates mean that the price of your travel arrangements may change after you have booked. You will be
advised as soon as possible after we become aware of any such changes.
Credit Card payments will incur a 3% merchant fee. We accept Visa, Master Card and American Express credit cards. In accordance with regulations, we
require a signed and validated Standard Credit Card Charge Form to be completed and sent to us.
If you are paying by bank electronic transfer, we will advise you of our bank details.
Departure times may change due to air traffic control restrictions, weather conditions or operational requirements.
Please ensure that you advise us of any special travel requirements that you may have.
Comprehensive travel insurance is strongly recommended for all your travel arrangements, including cancellation due to illness, accident or injury,
personal accident and personal liability, loss of or damage to baggage as well as medical insurance. We will not be responsible or liable for any insurance
claims of any nature whatsoever.
Service providers have extremely high cancellation fees and or date change penalties and the insurance cover offered by credit card companies is
insufficient to fully cover such fees, including medical and booking cancellations and claims of any other nature.
Travel documents include flight tickets or any other document (whether in electronic form or otherwise) used to confirm a travel arrangement with a
Service Provider. Travel documents may be subject to certain conditions and restrictions including non-refundable, non-date changeable and subject to
cancellation and amendment fees. An incorrect name on a booking may result in an inability to travel on that booking and the booking being cancelled. It is
your responsibility to observe all check in and departure times. Please note that travel services described as “direct” will not necessarily be non-stop.
UNSCHEDULED TRAVEL ARRANGEMENTS
In the event of any unscheduled travel arrangements caused by bad weather, strikes, operational considerations or any other cause which is beyond our
control or that of the Service Provider, it is understood that any expenses relating to these causes will be for the account of the passengers. We do not
accept any liability for any changes, omissions, or delays occasioned by technical difficulties, weather conditions, strikes or communication breakdowns or
Except where otherwise expressly stated in these Booking Terms and Conditions, we do not accept any liability or pay any compensation where our
performance is affected or prevented or you otherwise suffer any damage or loss, as a result of “force majeure”. In these Booking Terms and Conditions,
“force majeure” means any event which we or the Service Provider in question could not, even with all due care, foresee or avoid. Such events may include
war, threat of war, civil strife, riot, terrorist activity, industrial disputes, natural disasters, adverse weather conditions, fire and all similar events outside our
or the Service Providers control.
To the extent permitted by law, we do not accept any liability in contract, tort or otherwise and you hereby indemnify Safari Air Wing (Pty) Ltd from any
claim for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by the acts,
omissions or default, whether negligent or otherwise, of third party Service Providers over whom we have no direct control, force majeure or any other
event which is beyond our control or which is not preventable by reasonable diligence on our part.
As we are agents only for the nominated Service Providers, we accept no liability whatsoever for any loss, damage, injury, accident, delay or any other
irregularity howsoever arising. We will make every effort to ensure that all travel arrangements and services will be carried out as specified in the most
effective way possible. However, we do not have direct control over the provision of services by Service Providers whilst they are in every instance selected
with great care, we do not accept liability for any errors and omissions of such Service Providers. The contracts in use by such Service Providers (which is
often constituted by the issuing of a ticket), shall constitute the sole contract between the Service Provider and you and any right of recourse you may have,
will be solely against the Service Provider.
The Passengers shall indemnify and hold harmless Safari Air Wing (Pty) Ltd, their respective Directors, successors and assigns from any and all losses
connected directly or indirectly with the services, equipment and facilities provided by Safari Air Wing (Pty) Ltd and its nominated travel Service Provider.
BOOKING CHANGES OR CANCELLATIONS
If you change your booking:
If you undertake to make a change to your booking, we will endeavour to assist you to make the change wherever this is possible. You will have to pay all
charges, whatever kind, imposed by the Service Provider providing that component of your travel arrangements, when amending a booking. An
administration fee of R200.00 per person will be charged for each booking changed as well as any other fees imposed by the Service Provider. After
departure, it is understood extra expenses incurred as a result of any booking changes will be for your account and any unused service will not be
If you cancel your booking:
Cancellation of your booking before the cut-off date will incur no cancellation fees. Bookings cancelled after the cut-off date will incur cancellation fees. In
some instances Service Providers will charge 100% cancellation fees. Where we incur any liability for a Service Provider’s cancellation fee for any booking
which you cancel, you agree to compensate us for the amount of that fee. Where you seek a refund for a cancelled booking for a payment that has been
made to a Service Provider, we will not provide a refund until we receive the funds from the Service Provider.
For operational reasons, a Service Provider may be required to make changes to your original booking. We do not accept any liability or costs incurred that
may result from such changes. Please note that a Service Provider may be subject to change, as well as departure times and travel arrangements. In certain
circumstances, we or a Service Provider may be required to cancel your travel arrangements (for example if you fail to pay the final balance, force majeure
OUR RESPONSIBILITY FOR YOUR BOOKING
In all circumstances, we will not be liable where any failure in the performance or provision of your travel arrangements is due to: (a) your acts or omissions
or the acts and omissions of another member of your party (b) any third party not connected with the provision of your travel arrangements and where the
failure is unforeseeable or unavoidable (c) unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been
avoided even if all due care had been exercised or (d) an event which we or the Service Provider, even with all due care, could not foresee or forestall
(including but not limited to war, riot, disturbances, industrial dispute terrorist activity and its consequences, natural or other disaster, fire, adverse
weather conditions (actual or anticipated), closed or congested airports, unavoidable technical problems with transport or similar events. Regardless of the
type of travel arrangements that you book with us, the Service Provider will have their own Booking Terms and Conditions. All such Booking Terms and
Conditions (including limitations of liability) apply to these Booking Terms and Conditions and accordingly, a reference to “These Booking Terms and
Conditions” shall mean the Booking Terms and Conditions set out herein as well as all the Booking Terms and Conditions of any Service Provider. To the
extent of any inconsistency between a Service Providers Booking Terms and Conditions and the Booking Terms and Conditions set out herein, the travel
Service Provider’s Booking Terms and Conditions shall prevail, save to the extent that any provision of the travel Services Provider’s Booking Terms and
Conditions is deemed to be invalid or unenforceable. It is incumbent on you to read all applicable travel service provider’s Booking Terms and Conditions
carefully because in every case they will apply to the provision of your travel services.
We are committed to protecting your personal information. We and the nominated Service Provider may disclose your personal information to other
parties who are directly connected with facilitating your travel arrangements and bookings. At all times we retain the right to monitor, retain and disclose
any information as necessary to satisfy any applicable law, regulation, legal process or government request.
If any dispute arises between you and us, the Laws of South Africa will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the
courts of South Africa and waive any right that you may have to object to an action being brought in those courts.
ACCEPTANCE OF BUSINESS TERMS AND CONDITIONS
Acceptance of these Booking Terms and Conditions shall constitute a contract of carriage between passengers and the nominated travel Service Provider
and you hereby acknowledge that no contract will exist between passengers and Safari Air Wing (Pty) Ltd.
